Red Energy Pty Ltd (Red Energy) has paid $254,436 in penalties after we issued penalty notices on 1 September 2023.
We issued penalty notices to Red Energy after they allegedly communicated incorrect best offer information to 30,982 customers over a two-week period in 2022, and allegedly failed to provide 15 customers with best offer information on their bills within prescribed timeframes over a period of three years (2019-22).
Consumers need to have clear, timely and transparent information about energy offers to engage confidently with the energy market, and to make sure that they can make informed decisions about their energy offers. The Energy Retail Code of Practice includes the obligation on energy retailers to advise customers via their energy bills if the customer is on their best offer, and how much money a customer could save by switching if a better offer is available. This must occur every three months for electricity bills, and every four months for gas bills.
It is alleged that Red Energy breached these rules by allegedly communicating incorrect best offer information to customers and allegedly failing to provide customers with best offer information within prescribed timeframes.
