Click Energy penalty notices 2021 (explicit informed consent)

Click Energy has paid penalties totalling $640,000 after we issued 32 penalty notices on 28 May 2021. The amount payable for each penalty notice was $20,000.

In these notices, we alleged that Click Energy failed to obtain explicit informed consent before transferring 20 customers, across 32 accounts, to Click Energy between 1 September 2020 and 25 September 2020.

The Energy Retail Code requires energy retailers to obtain explicit informed consent before transferring a customer. Retailers must clearly, fully and adequately disclose all matters relevant to the customer's consent, including each specific purpose or use of that consent.
